Terms of Use — SiteUP Agendador de Posts (Hermes Studio)

These Terms of Use ("Terms") govern access to and use of the software application registered with the social media platforms as "SiteUP Agendador de Posts" and known internally as "Hermes Studio" (the "Service", "App", or "Hermes Studio"). By accessing or using the Service, you ("you", "User") agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Identification of the Service, Operator and Controller
The Service is developed and operated by SiteUP, a marketing agency ("SiteUP", "we", "us", or the "Operator"). The Service is operated exclusively on behalf of a single client, Jan Val Ellam (the brand "MENTALMA", spiritual and philosophical content), who is the owner of the connected social media accounts and the data controller in respect of the personal data processed through the Service (the "Client" or "Controller").
For all purposes under these Terms and under applicable data-protection law, SiteUP acts as the Operator (data processor) processing data on documented instructions of the Controller, Jan Val Ellam. The Service is hosted at https://socialmedia.janvalellam.com.br. Contact and Data Protection Officer (DPO): contato@siteup.com.br.
2. Description of the Service
Hermes Studio is an internal, self-hosted tool used to create, schedule and publish content to social media accounts. The Service publishes content only to the Client's own accounts — the accounts of Jan Val Ellam (MENTALMA) — which the authorized team connects through the official OAuth authorization flow of each platform.
The Service is not a multi-tenant SaaS product and is not offered to the general public or to arbitrary third-party users. It does not allow members of the public to register, connect their own accounts, or publish to accounts other than those owned by the Client. The Service exists solely to operate the Client's own presence on the connected social networks.
3. Eligibility and Access
Access to the Service is restricted to the authorized team of SiteUP that manages the Client's social media, by means of an internal login. There is no public sign-up. You may use the Service only if you have been expressly authorized by SiteUP and the Client and are at least 18 years of age. SiteUP may grant, restrict, suspend or revoke access at its sole discretion at any time.
4. User Accounts and Responsibilities
You are responsible for safeguarding the credentials used to access the Service and for all activity that occurs under your login. You must:
- Keep your login credentials confidential and not share them with unauthorized persons;
- Notify SiteUP immediately of any unauthorized use or suspected security breach;
- Ensure that all content you create, schedule or publish through the Service is accurate, lawful, and authorized by the Client;
- Use the Service only for the legitimate management of the Client's own social media accounts.
5. OAuth Connections and Third-Party Platform Terms
The Service connects to third-party social media platforms through their official OAuth authorization mechanisms, requesting only the minimum permissions (scopes) required to publish on the Client's own accounts:
- Pinterest:
boards:read,boards:write,pins:read,pins:write,user_accounts:read— to read the connected account's boards and create Pins on the owner's behalf. - TikTok:
user.info.basic,video.publish(Content Posting API) — to identify the connected account and publish videos on the owner's behalf. - YouTube / Google:
youtube.upload,youtube.readonly— to upload videos to and read the owner's own channel. - Meta / Instagram:
instagram_basic,instagram_content_publish,pages_show_list,pages_read_engagement,business_management— to identify the connected business accounts/Pages and publish content on the owner's behalf.
By connecting an account, you and the Client also agree to comply with the applicable developer and platform terms of each network, including the Pinterest Developer Guidelines and Terms, the TikTok Developer Terms of Service, the Google API Services User Data Policy and YouTube API Services Terms of Service, and the Meta Platform Terms and Developer Policies. Use of data received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. The Service does not access private messages, follower lists, or unrelated personal data. Each platform may suspend or revoke access to its API at any time, and such action is outside SiteUP's control.
6. Acceptable Use and Prohibited Conduct
You agree not to use the Service to:
- Send spam, post repetitive, deceptive, or misleading content, or engage in inauthentic or automated behavior that violates any platform's policies;
- Publish content that is unlawful, infringing, defamatory, hateful, harassing, obscene, or that violates any third party's rights;
- Violate the terms, policies or community guidelines of Pinterest, TikTok, YouTube/Google, Meta/Instagram, or any other connected platform;
- Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks;
- Interfere with, disrupt, reverse engineer, or circumvent the security or integrity of the Service;
- Use the Service to publish to any account not owned by the Client, or for any purpose other than managing the Client's own social media presence.
7. Intellectual Property and Content License
The Service software, its design, and SiteUP's and the Client's trademarks (including "Hermes Studio", "SiteUP" and "MENTALMA") are owned by SiteUP and/or the Client and are protected by intellectual property laws. No rights are granted to you except as expressly set out in these Terms.
All content created, uploaded, scheduled or published through the Service ("Content") belongs to the Client, Jan Val Ellam. You grant SiteUP, acting as Operator, the limited license to host, process, transmit and publish such Content to the connected platforms solely for the purpose of operating the Service on the Client's instructions. You represent that you have all necessary rights to the Content you submit and that its publication does not infringe any third-party rights.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, availability, or non-infringement. SiteUP does not warrant that the Service will be uninterrupted, error-free, or that scheduled publications will always succeed, as publishing depends on the availability, rate limits, and policies of third-party platforms over which SiteUP has no control.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SiteUP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill, arising out of or related to the use of or inability to use the Service, including failures, delays, or rejections of publications by third-party platforms, or suspension or termination of platform API access. This limitation applies regardless of the legal theory and even if SiteUP has been advised of the possibility of such damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Suspension and Termination of Access
SiteUP may suspend or terminate your access to the Service at any time, with or without notice, including for breach of these Terms, suspected misuse, security concerns, or upon instruction of the Client. You or the Client may disconnect any OAuth-connected account at any time through Settings > Connections > Disconnect, which immediately deletes the stored encrypted OAuth token for that network. Upon termination, the right to access and use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the domicile of the Operator in Brazil shall have jurisdiction over any dispute arising from these Terms, without prejudice to mandatory consumer or data-protection rules. Processing of personal data through the Service is governed by the Brazilian General Data Protection Law (LGPD — Lei nº 13.709/2018) and, where applicable to users in the European Union/EEA, the General Data Protection Regulation (GDPR — Regulation (EU) 2016/679). 12. Changes to These Terms
SiteUP may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice to the authorized team. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. These Terms are effective as of 2026-06-18.

A SiteUP é a operadora e o Jan Val Ellam é o controlador dos dados, nos termos da LGPD e do GDPR. O serviço publica conteúdo apenas nas próprias contas do cliente, conectadas via OAuth (Pinterest, TikTok, YouTube/Google e Meta/Instagram), e não é um SaaS multi-tenant — não há cadastro público.
O acesso é restrito à equipe autorizada da SiteUP, por login interno. O usuário é responsável por guardar suas credenciais e por garantir que todo conteúdo seja legal, exato e autorizado. Ao conectar uma rede, você adere aos Termos de Desenvolvedor de cada plataforma (Pinterest, TikTok, Google/YouTube e Meta). É proibido usar o serviço para spam, conteúdo ilícito, ou para violar as políticas das redes. O conteúdo publicado pertence ao cliente; a SiteUP recebe apenas a licença limitada para hospedar e publicar esse conteúdo conforme as instruções do controlador.
O serviço é fornecido "no estado em que se encontra", sem garantias, e a responsabilidade da SiteUP é limitada na medida máxima permitida em lei — inclusive quanto a falhas, atrasos ou recusas de publicação pelas plataformas. O acesso pode ser suspenso ou encerrado a qualquer momento; você pode desconectar qualquer conta em Configurações > Conexões > Desconectar, o que apaga imediatamente o token OAuth cifrado.
